Bench Bar Report Update

The latest edition of Bar Briefs – A publication of the Santa Cruz County Bar Association and Lawyer Referral Service published an article under the Second Quarter 2018 Bench Bar Report written by James Eschen, Esq., which states the following:

“What the court will not do is provide court reporters when the law does not require it to do so. Judge Burdick emphasized that there will be no court reporters available at judicial mediations. Under Code of Civil Procedure section 664.6, a settlement is only enforceable by motion if the parties sign it or put it on the record. The lack of court reporters forecloses the second alternative.”

Even though the court is not providing court reporters except for criminal cases, you are not precluded from hiring a freelance reporter for all of your civil litigation needs. Once again, court reporting proves to be a valuable tool in preserving your written record.
